- Nancy Brooks (65) was HOH in the 1850 Person Co. census, enumerated with David W. Brooks (23), George G. (17), Rachel Walker (30) and Thomas Walker (3).
Nancy died in late 1851 and her survivors petitioned for the sale of a slave named Gabriel so they could distribute the estate. Barnett posted $1200 bond on 17 Dec 1851 in Person Co. to be named administrator of Nancy’s estate.
“State of North Carolina, Person County, Court of Pleas & Quarter Sessions December Term 1851, To the worshipful the Justices of the Court of Pleas & Quarter Sessions for the County aforesaid, The Petition of William Brooks, Robert Brooks, Thomas Brooks, Lewis Brooks, David Brooks, & Grief Brooks, which latter is a minor under the age of 21 years & [?] on his behalf by his guardian ad litem Charles Mason, of Marcus Hamlett & wife Elizabeth, & of William Jones & wife Jane; Respectfully sheweth that Nancy Brooks late of the County of Person, State of North Carolina died sometime during the present year possessed of a negro slave named Gabriel; That she died intestate leaving your petitioners her children her surviving, by which death intestacy etc. the said slave came to your petitioners as tenants in common;
“Now your petitioners further shew that the only mode by which a just & equal division can be made between & among your petitioners is by sale wherefore they pray your worships to order & decree a sale of sald slave at such time & upons such terms as to your worships may seem proper;
“And that your worships will grant such other & further relief etc. etc. M. McGehee sol. for Pts.
“The Petition of William Brooks & others Ex Parte, This cause coming on to be heard upon the reading of the petition & the suggestion of counsel & the Court being satisfied of the truth of the matters therein set forth, it is ordered by the court that sale be made of the negro slave mentioned in the petition, that John A. Barnett be appointed commissioner to sell said slave, that he sell upon a credit of nine months, first making due advertisement, taking bond for the purchase money with approval security & that he report to the next Term of this Court.
